Composer Camps

1. Scope of application

1.1 These standard business terms (SBT) are valid for all contracts and services of “7 Ports Music” (hereinafter referred to as “service provider“) related to songwriting camps, which are held both nationally and internationally.

1.2 Differing terms on the part of the participant (hereinafter “participant”) are only applicable, if the service provider confirms it in written form.

 

2. Contractual item

2.1 The service provider organizes and conducts songwriting camps, which include workshops and seminars on songwriting, songwriting sessions, recording sessions and music production sessions. The exact content and scope of the camp is defined in the respective tender or contract.

 

3. Conclusion of contract

3.1 A contract is concluded when the participant registers for a songwriting camp in writing or electronically and the service provider confirms the registration in writing. The place will then be reserved, but participation is only secured or valid after the participation fee has been paid in full.

3.2 Supplements and amendments of this agreement require written form.

 

4. Participation fees and payment terms

4.1 The participation fees for the songwriting camp is based on the prices stated in the contract.

4.2 Payments are due without deductions within 14 days of the invoice being issued, unless otherwise agreed. Participation is only valid after full payment.

4.3 In case of late payment, the service provider reserves the right to charge default interest of 5% above the base interest rate.

4.4 The participation fee includes the services described in the contract. Additional services requested by participants are billed separately, and are not included in the participation fee, unless otherwise agreed.

 

5. Cancellation and withdrawal

5.1 The participant can withdraw from the contract by firstly notifying the service provider in written form and secondly having the service provider confirm the withdrawal in writing.

5.2 In case of withdrawal the following cancellation fees are valid:

  • Up to 3 months before the start of the camp: 70% of the participation fee

  • Less than 6 weeks before the start of the camp: 90% of the participation fee

5.3 The service provider reserves the right to cancel the camp for important reasons (e.g. force majeure, illness). In this case, the participation fee already paid will be refunded or an alternative date will be agreed.

5.4 The service provider recommends that participants take out cancellation and travel insurance on their own behalf.

 

6. Services and amendments

6.1 The service provider guarantees to provide the services described in the contract and/or written agreements.

6.2 The service provider reserves the right to change the program, the content or the “Composer Camp” team for important reasons, provided that this does not significantly affect the character of the camp.

 

7. Duty to collaborate

7.1 The participant actively participates in the camp and follows the instructions of the speakers and organizers.

7.2 The participant is responsible for bringing all required materials (e.g. instruments, tools such as laptops, notes) with them, unless otherwise agreed.

 

8. Liability

8.1 The service provider is only liable for damage caused by itself and which is based on intentional or grossly negligent behavior.

8.2 The service provider is only liable for its own slight negligence if essential contractual obligations are violated. In this case, liability is limited to the foreseeable damage that is typical for the contract.

8.3 The service provider assumes no liability for participants' personal belongings or for damage caused by the by improper use of the materials provided.

8.4 Participants who are addicted to drugs are not allowed to take part. In the event that the participant disrupts or prevents the course of the camp, the service provider reserves the right to expel the participant from the camp without refund.

 

9. Copyrights

9.1 All rights to the compositions, lyrics, recordings, and productions remain with the respective authors.

9.2 However, the service provider receives the right to use the works created in the camp for self-promotion, documentation and portfolio purposes, unless the participant expressly rejects them.

9.3 All content of this website (e.g. photos, videos, music, texts, design) is subject to copyright. All of this content may also be used by participants or partners, provided a written usage agreement is made.

 

10. Usage rights of content

10.1 Ownership of photos and videos

All photos and videos used on this website are the property of “7 Ports Music” or licensed to “7 Ports Music” unless otherwise noted. The use of this content for third parties is not permitted without explicit written permission.

10.2 Copyright of music and content

All music and content presented on this website are protected by copyright. This includes, but is not limited to compositions, arrangements, recordings and lyrics. The content is the property of “7 Ports Music” or third parties whose rights are protected accordingly.

10.3 Use of Content

The use, reproduction, editing or distribution of photos, videos or music published on this website requires the prior written consent of “7 Ports Music”.

10.4 Liability for third party content
If links to third-party content (e.g. social media, videos, music from third parties) are provided on this website, responsibility for the copyright compliance of this content lies with the respective provider. We assume no liability for the content of external links.

 

 

11. Confidentiality

11.1 The service provider and all participants commit themselves to keeping all confidential information received from the participants and the service provider a secret and not to pass it on to third parties.

11.2 This confidentiality obligation also remains valid after the end of the camp.

 

12. Data protection

12.1 The service provider collects, processes and uses personal data of the participants only within the framework of the legal provisions and exclusively for the purpose of conducting the camp or, if agreed in writing, exclusively for promotional purposes.

12.2 Further information on data processing can be found in the service provider’s data protection declaration.

 

13. International Regulations

13.1 These terms and conditions apply to all participants. For international participants, additional country-specific regulations may apply, which are agreed upon individually.

13.2 The contract language is German. By request of the participant an English version of the contract can be made. In case of contradictions, the German version is the valid one, though.

 

14. Applicable law and place of jurisdiction

14.1 Austrian law applies with the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

14.2 Place of jurisdiction for all disputes arising from or in connection with this contract is the competent court for the headquarters of the service provider.

 

15. Closing provisions

15.1 If any part, term or provision of this agreement is held to be illegal, in conflict with any law or otherwise invalid, the remaining portion or portions shall be considered severable and not be affected by such determination. The void provision will be replaced by a valid one, the economic purpose of which comes closest to the void provision.

15.2 Modifications and additions to this SBT require written form.
